Fines for oversize violations in Iowa.

Movement of Vehicles with Divisible Loads Exceeding Statutory Size or Weight Limits:

  1. Vehicles with divisible loads exceeding statutory size or weight limits may be transported under a single-trip permit if the permit-issuing authority deems a special or emergency situation justifies its issuance.

  2. The permit-issuing authority may, at its discretion, allow the combined gross weight to exceed statutory limits, but axle weights must adhere to rule 511.12(321,321E).

  3. Movement is subject to routes established by the permit-issuing authority.

  4. This rule excludes divisible loads of hay, straw, or stover. It is designed to implement Iowa Code sections 321.463 and 321E.29.

Regarding Violations:

  • For violations under sections 321.309, 321.310, 321.394, 321.461, and 321.462, the scheduled fine is thirty-five dollars.

  • For violations under section 321.437, the scheduled fine is thirty-five dollars.

  • Height, length, width, and load violations under sections 321.454, 321.455, 321.456, 321.457, and 321.458 incur a scheduled fine of two hundred dollars.

  • Violations under section 321.466 result in a scheduled fine of twenty dollars for each two thousand pounds or fraction thereof of overweight.

  • Violations of axle, tandem axle, and gross or group of axle weight violations in section 321.463 are scheduled violations subject to the provisions, procedures, and exceptions in sections 805.6 through 805.11, regardless of the fine amount in that schedule.

  • Weight violation charges, where the fine does not exceed one thousand dollars, are only issued via uniform citation and complaint.

  • For weight violation fines exceeding one thousand dollars, admission of the violation under section 805.9 results in charges via uniform citation and complaint, indictment, or county attorney's information. Otherwise, charges are issued only via indictment or county attorney's information.
