Fines for oversize violations in Arkansas

Any individual found violating the regulations outlined in this subchapter, or any owner, principal, employer, lessor, lessee, agent, or officer of a firm or corporation who allows such violations by an operator, shall be charged with a misdemeanor. Upon the first conviction, the offender will face a fine of no more than one hundred dollars ($100). For a second conviction within one (1) year, the offender will be subject to a fine of no more than two hundred dollars ($200). Subsequent convictions within one (1) year will result in a fine of no more than five hundred dollars ($500) per offense.

Regarding overweight violations:

  • For weights up to one thousand pounds (1,000 lbs.) over the limit, the penalty ranges from a minimum of ten dollars ($10) to a maximum of twenty dollars ($20).

  • For weights exceeding one thousand pounds (1,000 lbs.) but not exceeding two thousand pounds (2,000 lbs.) over the limit, the penalty ranges from a minimum of one cent (1) per pound of excess weight to a maximum of three cents (3) per pound of excess weight.

  • For weights exceeding two thousand pounds (2,000 lbs.) but not exceeding three thousand pounds (3,000 lbs.) over the limit, the penalty ranges from a minimum of two cents (2) per pound of excess weight to a maximum of four cents (4) per pound of excess weight.

  • For weights exceeding three thousand pounds (3,000 lbs.) but not exceeding four thousand pounds (4,000 lbs.) over the limit, the penalty ranges from a minimum of three cents (3) per pound of excess weight to a maximum of five cents (5) per pound of excess weight.
