Each violation of an operational or safety requirement specified in a special permit incurs a penalty, not exceeding one thousand dollars ($1,000) per violation.

Penalties for multiple violations of operational or safety requirements are cumulative, but the total penalty for the vehicle cannot exceed one thousand dollars ($1,000).

Weight violations exceeding established limits are penalized according to s. 316.545, while dimensional, operational, or safety violations are penalized according to paragraph (c) or s. 316.516, whichever is applicable.

Penalties for multiple violations accumulate for the vehicle.

Individuals who contravene the overloading provisions of this chapter are conclusively presumed to have caused damage to the state's highways due to overloading.

Penalties for overloading violations are as follows:

• $10 for excess weight up to two hundred pounds (200 lbs) over the maximum allowed.

• Five cents per pound ($.05) for each pound of weight exceeding two hundred pounds (200 lbs) over the maximum allowed.

• A maximum fine of ten dollars ($10) for the first six hundred pounds (600 lbs) of unlawful axle weight if the gross weight of the vehicle or combination of vehicles does not exceed the maximum allowable gross weight.
