Fines for oversize violations in Virginia.

  • The officer or size and weight compliance agent issuing the violation shall deliver a citation to the operator of the overweight vehicle, directed to the owner, operator, or other party deemed responsible for the overweight infraction as determined by the officer or size and weight compliance agent. Serving the citation to the vehicle operator shall be considered sufficient service of process upon the owner, operator, or other party accused of the weight violation as stipulated in § 46.2-1136. Any contested weight violation shall be adjudicated as a civil matter, with the attorney for the Commonwealth representing the interests of the Commonwealth. The case's outcome shall be documented in a suitable order, a copy of which shall be forwarded to the Department in place of any other required record as per § 46.2-383. If judgment favors the Commonwealth, payment shall be remitted to the Department.

  • Furthermore, the owner, operator, or other party responsible for the overweight violation will incur a $25 civil penalty, a $20 processing fee, a $2 weighing fee, and additional liquidated damages of $20.

  • In cases where the vehicle's gross weight surpasses the weight limit by 25% to 50%, the assessment is doubled. For gross weights exceeding 50%, the assessment is tripled. Fines are calculated based on the weight exceeding the permit limit.
