Fines for oversize violations in Delaware
In Delaware, any individual who violates regulations pertaining to the size and weight of a vehicle or combination of vehicles, as outlined in § 4512 of this title, shall face the following penalties:

A first offense will result in a fine ranging from $28.75 to $230, or imprisonment for up to 30 days, or both.

Subsequent offenses of a similar nature will incur a fine ranging from $115 to $575, or imprisonment for up to 60 days, or both.
Furthermore, any person who violates any provisions of this chapter, specifically concerning the weight of a vehicle or combination of vehicles, leading to its classification as an "overweight vehicle," shall be subject to the following additional penalties:

A first offense will result in a fine calculated as follows: 2.3 cents per pound for all excess weight up to and including 5,000 pounds, and 5.75 cents per pound for all excess weight over 5,000 pounds, or imprisonment for up to 30 days, or both.

Subsequent offenses will incur a fine calculated as follows: 5.75 cents per pound for all excess weight up to and including 5,000 pounds, and 11.5 cents per pound for all excess weight over 5,000 pounds, or imprisonment for up to 60 days, or both.
For the purpose of this section, a first offense is defined as one not previously committed by the charged individual within the preceding 24 months prior to the date of the offense. A subsequent offense is considered to have occurred if the charged individual has previously been convicted or charged, and subsequently convicted, of the same offense within the preceding 24 months prior to the date of the current offense.
