Fines for oversize violations in Illinois

  • According to Illinois law (625 ILCS 5/15-112), if a police officer suspects that the weight of a vehicle and its load exceeds legal limits, they have the authority to instruct the driver to stop and undergo a weighing process.

  • The officer can use portable or stationary scales for this purpose, or if unavailable, direct the vehicle to the nearest accessible scale.

  • If it is determined that the truck is overweight, the officer will charge the driver accordingly and impose the appropriate fine as specified under 625 ILCS 5/15-111.

  • Any individual who refuses or neglects to comply with the directive to stop and submit their vehicle and load, as issued by an authorized agent of the city, or who removes or causes the removal of any part of the load before weighing, is subject to a fine ranging from not less than five hundred dollars ($500) to a maximum of two thousand dollars ($2,000).

For weights up to 24,000 pounds, there is a base fee, and for each additional increment of 500 pounds overweight or fraction thereof, an additional fee of $75.00 applies. Moreover, for each $40.00, or fraction thereof, of the incremental amount, an extra charge of $4.00 is added.
