Fines for oversize violationsin Indiana.
Violations related to size and weight limits incurred by the operation of a vehicle or combination of vehicles (IC 9-20-4 and 9-20-5) or a garbage truck (IC 9-20-11) are considered continuous offenses. The prosecution venue for such offenses is in the county where the unlawful operation occurred. After a conviction or acquittal in one county, no further prosecution may be initiated in another county (IC 9-20-18-1).
All violations under IC 9-20, excluding weight violations of 5,000 pounds or more, are classified as Class C Infractions. In addition to fines, the Court may suspend vehicle registration for up to 90 days (IC 9-20-18-12(a) & (d)). An exception is provided by IC 9-20-18-12(c) for highways other than interstate highways if the weight violation is less than 1,000 pounds. IC 9-20-18-7(b) establishes a defense if the party can demonstrate a lack of reasonable knowledge of the actual weight of the load or lacked access to or control over the loading of an overweight load.
For weight violations between 5,000 and 10,000 pounds, they are categorized as Class B Infractions. If the weight violation exceeds 10,000 pounds, it is treated as a Class A Infraction (IC 9-20-18-12(b)). In all weight violation cases, the Court may suggest a suspension of the chauffeur's license if the violation was knowingly committed (IC 9-20-18-12(e)).
