When both gross and axle weight limits are surpassed, the penalty is determined by the violation incurring the higher fine.

For violations of section 2355, a minimum fine must also be imposed for any other applicable violation of section 2355 according to subsection 9.

On the Interstate Highway System, the minimum fine for exceeding gross vehicle weight or axle weight limits is $60, plus court costs, and cannot be waived.

On all other highways, the minimum fine for such violations is $30.

Operating a motor vehicle in violation of any axle or group of axles weight provision or gross vehicle weight is a traffic infraction if the vehicle is:

A. Exceeding the allowed basic weight by 1% to 10%

B. Exceeding the allowed basic weight by 11% to 20%
​
C. Exceeding the allowed basic weight by 21% to 30%
​
D. Exceeding the allowed basic weight by 31% to 40%
​
E. Exceeding the allowed basic weight by 41% to 50%
​
F. Exceeding the allowed basic weight by more than 50%.
