• Violators of weight laws in West Virginia face fines based on the amount by which they exceed weight limits, and their vehicles may be impounded. The individual responsible for the violation is also accountable for reasonable storage expenses related to impounded vehicles. However, if the vehicle owner is a resident of or has a primary business location within the state and the vehicle is duly licensed in West Virginia, the arresting officer cannot impound the vehicle. Instead, the officer must provide the operator with a written notice detailing the violation, including the location, date, and time of the offense, as well as the vehicle's license and title numbers, the owner's name and address, the driver's information including address and commercial driver's license number, and the court details for the hearing, which must take place within ten days of the violation.
